Common Grounds for Appeal
1. Procedural Errors
Mistakes made during the trial process, such as improper jury instructions or the admission of inadmissible evidence, can serve as grounds for appeal.
2. Sentencing Issues
If a sentence is deemed excessively harsh, it can be challenged through an appeal.
3. A Violation of One or More of Your Constitutional Rights
4. Ineffective Assistance of Counsel
If you believe your attorney did not provide adequate representation, this could be a basis for an error on appeal. However, direct appeal may not be the stage of proceedings to raise a claim for IAC. You and your attorney can discuss what your best legal strategy is when developing such claims and whether you should wait to address this issue in a petition for post conviction relief.
